1. Who We Are

These Terms of Service ("Terms") govern your access to and use of the website mistsystem.id and any related services (together, the "Service") operated by PT Tom Marvolo Riddle Group ("Mist System", "we", "us"), a company registered in Bali, Indonesia.

2. Acceptance of Terms

By accessing the Service, submitting a contact form, or communicating with us via WhatsApp or phone, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

3. Description of Services

Mist System designs, supplies, installs, and services high-pressure mist cooling systems for hospitality, commercial, and residential venues in Indonesia. The website provides product information, project examples, pricing guidance, and a contact channel for requesting a personalised quote.

Any information published on the website — including prices, coverage areas, and technical specifications — is indicative and does not constitute a binding offer. A binding agreement is formed only upon our written confirmation of a specific quotation.

4. Quotations and Orders

• Quotations are valid for 14 days from the date issued unless stated otherwise.
• Orders are confirmed once a down payment is received in line with the quotation terms.
• Delivery times, installation dates, and scope of work are defined in the signed quotation.
• Any changes to the scope of work after confirmation may result in price and timeline adjustments.

5. Payment

Payment terms, currency (IDR), and schedule are specified in the individual quotation. Late payments may delay delivery or installation and may incur administrative fees as defined in the signed quotation.

6. Warranty

Mist System provides a one (1) year limited warranty on the mist cooling machine only, starting from the date of installation. The warranty covers manufacturing defects under normal operating conditions and correct maintenance.

The warranty does not cover:

• Nozzles, filters, fittings, and other consumable parts
• Damage caused by improper use, modification, or third-party repair
• Damage caused by poor water quality, power surges, or force majeure
• Routine cleaning, scale removal, and filter replacement

7. Intellectual Property

All content on the website — including text, images, logos, project photos, video, and source code — is the property of Mist System or its licensors and is protected by copyright and trademark laws. You may not reproduce, modify, distribute, or publicly display any content without prior written permission.

8. User Conduct

When using the Service, you agree not to:

• Submit false, misleading, or fraudulent information through any form
• Attempt to access, probe, or disrupt the website's security or infrastructure
• Use automated systems to harvest contact details or scrape content
• Use the Service for any unlawful purpose or in violation of Indonesian law

9. Third-Party Services

The website uses third-party services for analytics and advertising measurement (Google Analytics, Meta Pixel, Google Ads) and for lead management (Kommo CRM). These services are governed by their own terms and privacy policies. See our Privacy Policy for details.

10. Limitation of Liability

To the maximum extent permitted by Indonesian law, Mist System shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the total amount paid by you for the specific order giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Mist System, its directors, employees, and contractors from any claim or demand arising out of your breach of these Terms or your misuse of the Service.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising from or related to these Terms shall be resolved by the competent court in Denpasar, Bali, unless otherwise agreed in writing.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes have been posted constitutes acceptance of the revised Terms.
